1. Terms and Conditions

● Welcome to Skylife Pro. Thank you for using our products and services.
● Skylife Pro is a trading name of Chock2Chock LTD (the “Supplier”) registered in the United Kingdom (Registered number 09635074).
● Please read the Terms of Service carefully (“Terms”). All of the Terms collectively form an “Agreement”.
● These Terms govern and apply to your access and use of Skylife Pro’s Services available via the Skylife Pro website www.skylifepro.com and via Skylife Pro’s mobile apps (collectively, the “Service”). The combination of the Software, the Website, the Skylife Pro Servers and Customer Support form this Service.
● Use of the names Skylife Pro and Chock2Chock LTD and the terms - we, our, ours and us, are interchangeable when related to the Terms and Services in this Agreement, and all relate to the Supplier of the Service.
● By accessing or using our Service, or by downloading any software / applications related to the Service, you agree to be bound to all of the Terms and Conditions described in this Agreement from the published date of 12th November 2019.
● If you do not agree with the Terms in this Agreement you are not permitted to use the Service.
● We reserve the right to amend this Agreement at any time and without notice and if we do this, we will post the amended Agreement on our Web page and publish within our mobile apps, indicating the date the Agreement was last revised.
● Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to any of these Terms or any future Terms, do not use or access (or continue to access) the Service. This Agreement applies to all visitors, users, and others who access the Service (“User”).
● Use of the words User, Users”, you, your, yourself, yours or their is interchangeable in this Agreement and all refers to the User.
● If you are accessing or using the Service on behalf of a company or other legal entity, you represent and warrant that you are an authorized representative of that entity and have the authority to bind such entity to this Agreement, in which case the term “User” shall refer to yourself and that entity together.
● If you have not agreed with the Terms in this Agreement, please submit a request via the Contact Us facilities on the website or in the mobile apps, to request the removal / deletion of your personal data.
● If English is not your mother tongue you must seek advice before using the Service, to ensure that you have fully understood the Terms in this Agreement.
● This Agreement forms a contract between the User and Chock2Chock LTD for use of the Service

2. Governing Law

● This Agreement and its Terms are governed under English law and any claims related to The Agreement can only be made through the English legal system.

3. The Service

● Skylife Pro gathers data, used in the day to day duties of both Pilots and Cabin Crew, from multiple source systems that they already have access to, and processes it and presents it in a form which facilitates easier working practices for them as The User
● The Service is designed with data security in mind and, as a consequence, the User must be aware that there are multiple layers of password and encryption used and required throughout the website, mobile apps and systems of Skylife Pro
● Based on the Airline/Company that The User works for (the “Company”), The Service accesses different airline systems, which The User will log into via The Service.
● Nobody other than the User is permitted to access the Service.

4. Limitation of Liability and Warranty

● By logging into the Service and the User’s Company and Third Party systems via the Service, The User is confirming that they have reviewed their Company policies and have the appropriate right to be using the Service.
● The Service is not endorsed, affiliated or approved by any airline company, nor any aviation authority. The User should not use The Service if its use is prohibited by their employer or by local authorities. By using the Service, the User is confirming that they are contractually allowed to use the Service by their Company and are not in breach of any aviation authority policies by doing so.
● Skylife Pro reserves the right to refuse to allow any potential User from signing up or using the Service without giving a reason
● Skylife Pro cannot guarantee the accuracy of data, or availability of data and as a consequence, the User must be aware that, in no event will Skylife Pro be liable for indirect, incidental or consequential damages (including, but not limited to, loss of stored data, loss of income, loss of business information, business interruption) arising out of the use of, or from the inability to use the software, even if Skylife Pro has been advised of the possibility of such damages.
● Skylife Pro will do our best to adapt the site to any changes in the User’s Company rosters and server interfaces, but we cannot guarantee this will take place, or give any degree of timescale. We will do our best to fix any faults reported, but cannot be held responsible for any incorrect times, missing duties, errors or wrongly stored data.
● It is always the User’s responsibility to cross check data with the Users Company’s published rosters.
● Skylife Pro has, and will continue to, make reasonable checks of the software, to confirm that it will perform as expected on compatible equipment. However, due to the inherently complex nature of software and the wide variety of platforms, we are unable to warrant that the software is free from errors, will operate without interruption or is compatible with all equipment and or software.
● A working internet connection is required to facilitate the refresh of data. It is the User’s responsibility to establish and maintain this working internet connection.
● The User accepts all risks associated with the use of the Service. Skylife Pro makes no warranties expressed or implied, with respect to the Service, their merchantability, or their fitness for any particular purpose. Should the Service or any part thereof prove defective, the User will assume the entire cost of all support, repair and/or correction.
● All data that the User views, retrieves, receives or handles via SkyLife Pro is of a very sensitive nature and should be handled accordingly with due care and consideration. The User is solely responsible for ensuring compliance with your Company Regulations and any Data Protection Acts.
● Parts of the Service allow the sharing of personal views. Users must be respectful when using this part of the Service. You must not share any content that creates or may create a risk of harm, loss, damage, physical or mental injury, emotional distress, disability, disfigurement, physical or mental illness or dead, to any other user of the Service or to any other person or property. You shall not transmit any content that is unlawful, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive of personal privacy or publicity rights, harassing, humiliating to other people (publicly or otherwise), libelous, threatening, or otherwise objectionable, any content that contains any information that you do not have a right to make available under any law or under contractual or fiduciary relationships. You shall not post any content that violates third-party rights of any kind, including and without limitation, any Intellectual Property Rights, rights of publicity and privacy, or copyright.
● Skylife Pro cannot be held liable for any content shared via the Service.
● British Airways (“BA”) staff only - We specifically ask that Users check their compliance to policies EG801, EG802, EG803 and any other company IT security policies before using the Service.

5. Indemnity

● By using the Service, the User agrees to defend, indemnify and hold harmless Skylife Pro and our suppliers, employees, directors and contractors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to legal fees) arising from the use of and access to the Service, including any data or work transmitted or received by you; any violation of any Term of this Agreement, including without limitation, breach of any of the representations and warranties above; violation of any third-party right, including without limitation any right of privacy, publicity rights or Intellectual Property Rights; violation of any law, rule or regulation of any country; any claim or damages that arise as a result of any of your posted content; or any other party’s access and use of the Services with your unique username and passwords

6. Use of Third Party Apps & Programmes in conjunction with This Service

● SkyLife Pro has been designed to sync the User’s data to other third party apps and programmes e.g. to the Calendar on a mobile phone, or to print to a local printer.
● Although every effort is made to maintain this extra service, Skylife Pro are unable to guarantee that it will always be possible to sync or print.
● It is the User’s responsibility to check that the data has synced correctly. SkyLife Pro cannot be held accountable, to either the User or their Company or any other party, for any financial loss or damages arising from the use of incorrect data syncing with other third party apps or programmes, or from any inability to print.

7. Data & Data Protection:

● By accessing the Service the User is giving their consent and authorisation to Skylife Pro to act on their behalf to access, store and read the data from their Company and any relevant Third Party system that they use in their day to day work. They also consent to Skylife Pro processing the data from these sources for the sole purpose of delivering the Service.
● The User should consider their geographic location and laws of the country they are in, before accessing the Service, as their data may be transmitted via the telecommunications systems of that country and/or be subject to the laws of that country or jurisdiction. By accessing the Service, The User is confirming that they have the right to access their data in that country or jurisdiction and take full responsibility for all consequences of doing so.

Data Storage and security
● It is the Users responsibility to keep their login details and data (displayed, downloaded, saved or printed), secure from any third party.
● Skylife Pro takes all reasonable steps to securely store data, and any passwords that need to be stored for provision of the Service, will be stored in an appropriately encrypted format
● User data is regularly backed up and a copy of the backed up data is stored on SkyLife Pro devices, including regular encrypted backups outside the SkyLife Pro servers. However, Skylife Pro do not accept any responsibility for the loss or corruption of data stored on the servers or communicated to and from the servers or applications for any reason.
● It is the responsibility of the User to regularly make a back up of their data by saving their roster, flight information and their logbook to their own storage device
● A CSV format copy of the logbook can be requested and will arrive via email, acting as a master copy of the logbook data
● Skylife Pro reserves the right to use or view any data generated or stored for a User by the Service, for the purposes of providing support, maintaining and developing our services.
● Skylife Pro will not make the User’s Company or personal data available to any other user or Third Party except as required by the following cases:
○ Where Skylife Pro is required to, in order to comply with the laws of the country in which the User, Skylife Pro, the User’s Company, The Third Party or the data is based.
○ Where a User has specifically requested that their data be passed on.
● The Skylife Pro website uses cookies to facilitate the faster operation of the Service.

Personal Data
● Skylife Pro uses Personal Data to effectively operate the Service. By using the Service, The User is agreeing to Skylife Pro storing and accessing this personal data and using it as part of the operation of The Service. The User is also agreeing to the use of this personal data, including but not limited to the User’s flight data, by Skylife Pro for testing and further development of the Service.

Deletion of data
● Should the User wish to delete their account, or request a copy of the personal data held about them, they should send an email via the Contact Us forms on the website, or on the mobile apps.
● For data protection reasons, Skylife Pro may try to confirm the identity of a User before sharing any personal data.
● For further information, please use the Contact Us facility.

Communication and Marketing
● By accessing the Service, The User is granting Skylife Pro the right to communicate to them, via email and text, in lieu of any communication by post, using the details provided at sign up, or as updated by the User during their usage of the Service.
● This right of communication by email, in lieu of any communication by post, includes the communication of all legal notices,
● Skylife Pro will not sell or pass on personal details to Third Parties without consent of the User.
● Skylife Pro will use contact details to provide the User with Service updates and to provide daily duty briefings. Skylife Pro reserve the right to turn off the daily duty briefing without notice.
● Service updates and briefing emails may contain marketing from 3rd parties, but communication will always come from Skylife Pro, not directly from the 3rd parties.
● The website or mobile apps may also contain marketing from third parties.
● If the User chooses to click on the marketing links contained in either emails, the website or mobile apps provided as part of the Service, they may be taken to Third Party sites, which Skylife Pro does not own, or have any liability for in any way.

Requesting a copy of your logbook data
● If the User wishes to have a copy of their logbook data, they may request it in PDF or CSV format via the Contact Us facility. Please note that this service is only available for fee paying subscribers and Skylife Pro will not offer additional support with the exported data file.

8. Subscriptions and refunds:

● Some parts of the Service can only be accessed via a subscription
○ By purchasing a subscription the User is entitled to access the Service for the period of the purchased subscription. However, Skylife Pro reserves the right , in the event of fraudulent, misappropriate use or voided payment, to suspend or even remove with immediate effect, a User’s account, without prior notification.
○ Please note that the subscription is for access to the Service only and no physical products or media are shipped.
● For parts of the Service that can be accessed without a subscription, Skylife Pro reserves the right to withdraw access at any time, or introduce a fee for use of that part of the Service, without the need for explanation or prior notice.
● Skylife Pro will not be liable for any implication of any type from removing the Service, for subscribing or none subscribing Users.
● Skylife Pro reserves the right to change the subscription fee or introduce different types of subscription without notice. If we do change the subscription fee, then the new fee or fee types will be applicable from the end of the purchased subscription period.
● Due to the nature of our business and the use of up-front and other types of free periods, any money that is paid is non-refundable, except where required by law. For example, Users subscribing from the European Union have the right to cancel their paid subscription within 14 days of signing up, upgrading or renewing a subscription. They must do this by using the Contact Us facility on the website or mobile apps
● In the unlikely event that the Service is defective, Skylife Pro will try to remedy the issue, but without any guarantees or obligations. The User cannot obtain a refund when a part of the Services is defective or is removed and should use the free period to test all aspects of the Service.
● The User understands and agrees that Skylife Pro may stop the Service at any time, without reason, without prior notice and without any refund or restitution.

9 . Recommend a Friend:

● From time to time SkyLife Pro runs a 'Recommend a Friend' scheme.
● This is an offer by which a registered User can receive an extension of 1 month to the expiry date of their paid subscription period, for each User that fully completes the registration process and activates their account as a new User of Skylife Pro.
● This offer is only available to Users with a paid subscription.
● Skylife Pro reserves the right to introduce and remove this scheme at any time without notice

10. Tax Calc / Tax Calculation Service

● For an additional annual fee, SkyLife Pro can produce Flight Schedule and Stats guidance for use in a UK non residency calculation.
● This data is synced via the User’s logbook and manual input is required by the User to select User preferences.
● The output created via this part of the Service is to be treated as a guidance document only. It is solely the responsibility of The User to ensure that their logbook data is correct and that the data published by this part of The Service is calculated correctly.
● The User can contact Skylife Pro to help update the tax rulings within this Service if necessary and appropriate to do so.
● SkyLife Pro cannot be held accountable, to either the User, their Company / Airline or any other party, for any financial loss or damages arising from the use of this part of the Service or the data coming from this part of this Service.
● Use of this Service does not constitute “Advice” and the User should seek professional Tax input from a third party before using the data for any Tax return or other purpose.

11. Proprietary Rights

● All rights, title and interest including, but not limited to, copyright and other intellectual property rights in and to the software (including but not limited to all files, graphics/images, and documentation) are owned by Skylife Pro. Such rights are protected by international copyright laws and treaty provisions. The author retains all rights not expressly granted herein.
● Skylife Pro grants to the User a personal, non-exclusive, non-assignable and nontransferable license to use the Service.
● Unauthorised copying of the software, including the main software application and any associated files or written documentation is expressly forbidden. The User may not sublicense, assign or transfer this license or the software except as permitted by Skylife Pro.
● Skylife Pro stringently prohibit any type or kind of hacking, automated or manual scripting, used to obtain data from our servers.

12. (BA only) Fleetlist Trusted Partner Program (FTPP)

● Skylife Pro is part of the The Fleetlist Trusted Partner Program (FTPP) which allows Users of the Service from BA to access other BA Fleetlist member’s contact details from the Fleetlist community.
● In order to use Fleetlist data via the Trusted Partner application, users must themselves be “opted in” to sharing data with Trusted Partners within their Fleetlist profile.
● This data is sensitive and for personal use only!
● By using this Service the User is agreeing that they will not pass on the fleetlist contact details of any other Fleetlist users to anyone else (even to other members and colleagues in other departments). Other members must login and look-up contact details for themselves.
